Foster Wallace recently settled a car wreck case for a gentleman who was injured in a car wreck in Branson, Missouri. Our client was found by police and the insurance company to have some responsibility for the wreck but we were able to obtain an affidavit from the other driver who was also found to have some responsibility for the wreck that he was motioned out into traffic by an unknown vehicle. Because we were able to secure that evidence, we were able to negotiate with our client’s insurance company and obtain benefits under his uninsured motorist policy and obtain additional money for our client. This is known as the “phantom driver” rule in Missouri as we were able to pin the cause of the wreck on this unknown “phantom driver.” Our client was very happy with the result.
