Foster Wallace Secures $955,419.91 Policy-Limits Settlement for Client Seriously Injured in Kansas City Commercial Vehicle Accident

A Kansas City commercial vehicle accident changed one family’s life in an instant.

After a commercial cargo van failed to yield and caused a devastating T-bone collision, Foster Wallace Personal Injury Lawyers secured a $955,419 settlement for an injured father.

A Routine Drive Turned Life-Altering

In June 2024, a routine drive through Kansas City, Missouri, changed one man’s life in an instant.

Our client was lawfully operating his box truck southbound on Blue Ridge Boulevard when a commercial cargo van exited a nearby parking area and attempted to cross multiple lanes of traffic. The van’s driver failed to yield the right of way and drove directly into the path of the truck.

Despite an attempt to avoid the collision by changing lanes, our client was unable to prevent a violent T-bone crash. The cargo van struck the driver’s side of the truck, forcing it into the curb.

Kansas City Police responded to the scene. According to the investigating officer’s report, the at-fault driver admitted he never saw the truck approaching and failed to yield before crossing traffic.

Serious Injuries and a Long Road to Recovery

Our client, a 37-year-old married father of two and manager in the construction industry, was transported by ambulance to a local trauma center following the crash.

His injuries included:

  • Concussion with loss of consciousness
  • Wedge compression fracture of the first lumbar vertebra
  • Cervical sprain
  • Lumbar sprain
  • Left knee contusion
  • Post-traumatic headaches
  • Post-traumatic stress disorder (PTSD)
  • Additional accident-related injuries

The collision had a significant impact on nearly every aspect of his life. He was unable to work for approximately ten months and could no longer participate in many of the activities he enjoyed, including yoga, disc golf, hiking, and spending time outdoors with his family.

Perhaps most devastating was the timing. The client’s youngest child had just returned home from the NICU after a four-month stay. Because of his injuries, he was unable to fully care for and bond with his newborn during a critical period of the child’s early life.

Documenting the Full Extent of the Client’s Injuries and Losses

Over the next two years, our team worked closely with the client and his medical providers to fully document the extent of his injuries and losses.

The legal team coordinated treatment records and billing information from more than a dozen healthcare providers throughout the Kansas City area. To further support the claim, Foster Wallace retained both a life care planner and an independent medical examiner to evaluate the long-term effects of the client’s injuries and future medical needs.

In April 2026, the firm submitted a comprehensive policy-limits demand package to the at-fault driver’s insurance carrier. The demand included sixteen exhibits detailing liability, medical treatment, future care needs, wage loss, and other damages.

The client’s total damages were calculated at $3,901,724.21. However, to achieve a timely resolution, Foster Wallace demanded the full $1,000,000 liability policy available under the commercial vehicle driver’s insurance coverage.

Settlement Reaches Available Policy Limits

Following negotiations with defense counsel and the insurance carrier, the claim was resolved for $955,419.91.

The settlement represented the full liability policy limits available after accounting for property damage payments previously issued for towing expenses, the total loss of the box truck, and vehicle rental costs.

Why This Result Matters

Insurance companies rarely agree to pay policy limits without substantial evidence supporting liability and damages.

This result was made possible through a thorough investigation, extensive medical documentation, strategic use of expert witnesses, and a carefully prepared demand package that demonstrated the full impact of the client’s injuries and losses.

While no settlement can restore the time lost with family or undo the physical and emotional effects of a serious collision, securing every available dollar under the policy helped provide financial security and resources for the client’s future.

Injured in a Kansas City Truck Accident or Commercial Vehicle Crash?

Collisions involving commercial vehicles can result in life-changing injuries, significant medical expenses, lost income, and long-term rehabilitation needs. Unlike many passenger vehicle crashes, these cases often involve commercial insurance policies, extensive investigations, and complex damages calculations.
