$125,000 Combined Liability and UIM Recovery for Rear-End Collision in Burlington, Kansas

This motor vehicle collision occurred in July 2024 in Burlington, Kansas. Our client was stopped at a traffic light when her vehicle was rear-ended by another driver.

Liability and Insurance Coverage

The at-fault driver was insured by Bristol West Insurance Company with a $25,000 liability policy limit. Because the severity of our client’s injuries exceeded those limits, Foster Wallace also pursued an underinsured motorist (UIM) claim under our client’s own policy with Travelers Insurance.

Injuries and Medical Treatment

As a result of the collision, our client sustained serious neck and back injuries requiring extensive medical care. She was initially treated at a local hospital on the day of the crash and later received care from multiple medical providers.

Most significantly, imaging revealed bulging cervical discs, and our client ultimately underwent cervical fusion surgery involving the C4–C5 and C5–C6 levels. Medical records reflected that one of the affected discs was in close proximity to the spinal cord, with the potential need for additional fusion surgery in the future. Total medical expenses exceeded $60,000.

Settlement and Resolution

Foster Wallace Personal Injury Lawyers resolved the case without the need to file a lawsuit. The liability carrier paid its full $25,000 policy limits. After exhausting the third-party coverage, Foster Wallace pursued the UIM claim and secured the full $100,000 UIM policy limits from Travelers.

In addition to the settlements, Foster Wallace successfully addressed lien issues. A $4,500 PIP lien was waived in full, and other subrogation interests were resolved as part of the settlement process.
