If you have experienced a personal injury before but have not had a good experience with your attorney, you may be hesitant to go through the personal injury process again. You may have decided the process was too expensive, too time-consuming, or simply too much trouble.
Your experience with Foster Wallace will be different. We will handle every aspect of your case, from start to finish, so that you can focus on recovering from your injuries and returning to full health.
Here is what we provide at Foster Wallace, as we guide you through your personal injury process:
Free Initial Consultation
At Foster Wallace, your personal injury process begins with a free consultation. We will meet with you in person, discuss your case by phone, or perhaps do both. We want to hear your story. We want to know:
- What happened?
- What is the extent of your injuries?
- Have your injuries caused you to miss work?
- Have you received any medical treatment for your injuries?
- Have you been to the hospital or to see a doctor?
- How has this experience affected your family and loved ones?
- What is your treatment plan?
We want to listen to and understand your story. We also want you to understand what to expect. We will walk you through the personal injury process, step by step, so that you know we are fighting for you every step of the way.
Comprehensive Representation
If we are privileged enough to represent you, the first thing we will do is send our letter of representation to the other party and their insurance company. With that letter, they are placed on notice that Foster Wallace now represents you and your interests. This will prevent them from communicating with you or attempting to contact you. We want them to contact only us, so that you can focus on your recovery.
Negotiate for Maximum Settlement
After we understand the full extent of your injuries, we may be in a position to put together a demand on your behalf and deliver our demand letter. This is when we will tell your story to the insurance company. We will work with your doctors and service providers to obtain all the records and documents that support your claim, including:
- Summary of injuries
- Reports of missed work
- Treatment plans
- Medical Records
- Medical bills
- General Pain and Suffering
After we send the demand letter, we usually give the insurance company 30 days but sometimes longer in the appropriate situation to respond to our demand. The insurance company will then respond to our offer to settle the case. We will counsel you about whether the offer of settlement is fair, but we allow you to make the decision whether to settle your claim. Our only concern is to represent you and to communicate to the other party what you want.
At the same time, we will be communicating with your insurance company and service providers about your condition and recovery. We will make sure that you receive the treatment you need and that you can pay for your services from your personal injury settlement. This is what is called a “lien.” We will handle all of the complex issues that arise and counsel you, so that the process is as minimally stressful as possible.
Experienced Trial Attorneys
If a settlement is not reached through negotiations, we will assert your claim in court. We have the trial experience and litigation skills necessary to fight for you throughout your entire trial process as well.
Although the trial process moves slowly and may take as much as a year to work through, we will still fight for you at every stage of that process, which often includes:
- Depositions
- Expert testimony
- A mediation process with the other party
- More settlement negotiations
- Presenting your story to a jury
We will continue to work for maximum settlement. However, we will not be hesitant to go to trial. We will always be prepared—and prepare you—if your case ever goes to trial.
